MALACCA: A policeman and his close friend emerged from the Sessions Court here in high spirits after they were acquitted and discharged of a 2008 gang rape charge.
Judge Ahmad Sazali Omar released Syed Saiful Hairi Marzuki, 23, a policeman from Simpang Renggam, Johor and Mohd Radzi Abdul Rahim, 25, a public relation officer attached to a private hospital, after finding no element of force as alleged by the 19-year-old woman.
The court found that the prosecution failed to raise a case beyond reasonable doubt that the two had actually committed the rape.
“The teenager made no attempt to seek help although the place that the alleged rape took place was just metres away from a populated village,” he said.
Ahmad Sazali said the court discovered the teenager had feuds with her family members prior to reporting the alleged rape.
Syed Saiful Hairi and Mohd Radzi had allegedly took turns to rape the woman on June 18, 2008 at about 1am inside a shed in the outskirts of Kampung Belimbing Dalamin in Alor Gajah.
