Syariah family law provides for fine and jail

KUALA LUMPUR: The syariah family law gives protection against a third party who attempts to wreck a marriage.

Syariah lawyer Zainul Rijal Abu Bakar said a wife or husband could lodge a report with a state religious department enforcement officer for enticement.

He said the matter would be investigated and, if there was enough evidence, the syariah public prosecutor would charge the offender.

"Not only a husband can lodge a complaint against a man for enticing his spouse but a wife, too, can refer to the department against a woman," he said.


Zainul, who is also the secretary of the association, Lawyers in Defence of Islam, said offenders could be fined and jailed if found guilty.

He said a Muslim husband could also rely on section 498 of the Penal Code as it was a law applicable to all citizens.
